B. Third Party Services through Family Safety Assist.
Certain Family Safety Assist Services are offered by third party partners (“Third Party Providers”), who provide access to certain features or services according to your subscription membership plan level, as detailed in the Family Safety Assist Benefits and Features Guide.
You may choose to pursue additional services from Third Party Providers that fall outside of the Family Safety Assist benefits associated with your level of membership, such as arrangements for air travel, ground transport, lodging, medical treatment, and credit reporting and related credit products (“Third Party Services”). These Third Party Services must be contracted for separately with the applicable Third Party Provider. YOUR ACCESS TO THIRD PARTY SERVICES IS CONTINGENT ON A SEPARATE AGREEMENT AND PAYMENT AUTHORIZATION FOR SUCH SERVICES WITH THE APPLICABLE THIRD PARTY PROVIDER. WE ARE NOT A PARTY TO YOUR AGREEMENT WITH THE THIRD PARTY PROVIDER, AND SHALL INCUR NO OBLIGATIONS OR LIABILITY UNDER THAT AGREEMENT. YOU UNDERSTAND THAT THESE FAMILY SAFETY ASSIST TERMS, THE AGREEMENT AND COMPANY’S PRIVACY POLICY DO NOT APPLY TO YOUR USE OF THIRD PARTY SERVICES.
2. Privacy and Permissions
In order for you to access and use certain Family Safety Assist features, Company collects location, sensory and motion data from your mobile device in order to calculate and detect driving behavior and driving events (such as speeding, hard braking, distracted driving, collisions, precise location history and movements of a motor vehicle), provide emergency response services, compile reports, and otherwise provide or facilitate the Family Safety Assist features and services. This data is collected when you are in a moving vehicle, even if you are not the driver. If you do not have permission from the driver to collect this information, please be sure to deactivate the driver behavior and reporting and crash detection features. By using the driver behavior and detection features in a motor vehicle, you represent and warrant that you are the driver, or that you have the consent of the driver, for Company to collect and use location, movement and driving behavior information from your device to provide the Family Safety Assist features and for other purposes as described in our Privacy Policy.
You must have your device settings and permissions properly configured for many of the Family Safety Assist features and services to work properly. Certain features and services require Company to disclose your personal information to Third Party Providers that offer the Family Safety Assist Services. If you turn off or disable your device permissions, or withdraw consent for data sharing activities, some of these features and services may not be available or may not work properly.
Personal information collected by Company is governed by the Life360 Privacy Policy. Any personal information provided by Users to a Third Party Provider or a provider of Third Party Services in connection with the User’s use of Family Safety Assist Services (including but not limited to information related to a User’s location, medical and financial information, legal status, travel and personal documents, etc.) is collected by that Third Party Provider in accordance with its own privacy policy. COMPANY’S PRIVACY POLICY DOES NOT APPLY TO, AND COMPANY IS NOT RESPONSIBLE FOR, THE PERSONAL INFORMATION PRACTICES OF THIRD PARTY PROVIDERS AND PROVIDERS OF THIRD PARTY SERVICES.
3. Services Availability; Disclaimers
Please see the Family Safety Assist Benefits and Features Guide for a description of the benefits, features and services currently supported through Family Safety Assist Services. Family Safety Assist offerings are available only in the United States to Users in the United States, except as otherwise stated in the Family Safety Assist Benefits and Features Guide.
Your use of the Family Safety Assist Services includes the right to access the benefits available to the membership plan to which you subscribed. We or our Third Party Providers may add, remove or modify features, benefits or services at any time at our, or their, sole discretion, and we may add or remove Third Party Providers, but we will provide you with notice unless such changes are of minor nature. To the extent we make available any new or different features, functionality or enhancements to the Family Safety Assist Services, we may market these separately and may require the payment of additional fees. You agree that we shall not be liable to you or any third party for any modification of the Family Safety Assist Services in keeping with this section.
A. Not an Insurer.
You agree that Company is not an insurer and does not offer insurance coverage. Benefits offered as part of Family Safety Assist Services, such as roadside assistance and lost phone coverage (as described in Family Safety Assist Benefits Guide) are not insurance benefits, and are not a substitute for insurance coverage. The payments you make for the benefits (e.g., roadside assistance benefits or lost phone coverage) are not related to the value of your property (e.g., motor vehicle or lost phone) or any potential injury or damages to your property or you.
B. Use Family Safety Assist at Your Own Risk.
Family Safety Assist Services are designed to assist you in preventing loss to your property or to you personally, but neither Company nor our Third Party Providers guarantee that no loss will occur. TO THE EXTENT PERMITTED BY LAW, (A) YOUR ACCESS TO THE FAMILY SAFETY ASSIST SERVICES IS ENTIRELY AT YOUR OWN DISCRETION AND RISK; (B) YOU EXPRESSLY RELIEVE COMPANY AND OUR THIRD PARTY PROVIDERS FROM ANY AND ALL LIABILITY ARISING FROM YOUR USE OF FAMILY SAFETY ASSIST; AND (C) COMPANY MAKES NO WARRANTIES, GUARANTEES OR ASSURANCES, EXPRESS OR IMPLIED, ABOUT THE OPERATION, PERFORMANCE, AVAILABILITY, QUALITY, MEDICAL APPROPRIATENESS, OR EFFECTIVENESS OR RESULTS OF ANY OF THE SERVICES OFFERED THROUGH FAMILY SAFETY ASSIST.
C. Not Responsible for Third Party Providers.
CERTAIN FEATURES OF THE FAMILY SAFETY ASSIST SERVICES ARE PROVIDED BY THIRD PARTY PROVIDERS PURSUANT TO SUCH THIRD PARTY PROVIDER’S OWN TERMS AND CONDITIONS. COMPANY IS NOT LIABLE FOR THE ACTIONS OR INACTIONS OF ANY THIRD PARTY PROVIDER, ANY USER, 911 CENTER, EMERGENCY RESPONDER, ROADSIDE ASSISTANCE OR MEDICAL ASSISTANCE PROVIDER, OR ANY OTHER THIRD PARTY SERVICE PROVIDER. YOU EXPRESSLY UNDERSTAND AND AGREE THAT COMPANY’S PROVISION OF THE FAMILY SAFETY ASSIST SERVICES TO YOU, AND COMPANY’S PERFORMANCE OF OUR OBLIGATIONS UNDER THIS AGREEMENT, WILL NOT CONSTITUTE COMPANY’S ENDORSEMENT, APPROVAL, CREDENTIALING, OR RECOMMENDATION OF ANY KIND WITH RESPECT TO COMPANY’S THIRD PARTY PROVIDERS, THEIR PROVIDERS OR THE SERVICES EITHER PROVIDE. Some jurisdictions do not allow for the disclaimer of certain warranties, so the disclaimers above may not apply to you.
4. Special Terms for Identity Protection Services
Some online monitoring services may require you to complete registration with a Third Party Provider before the service can be activated. For example, credit monitoring services available through the Family Safety Assist Services are provided directly through IdentityForce and are subject to your registration directly with IdentityForce, including agreement to IdentityForce’s own terms governing your access to, and use of, such credit monitoring services.
5. Special Terms for Road Safety Services
Family Safety Assist includes road safety features, which (where available) may help detect automobile crashes when you are in an automobile and your phone is with you, may detect driver behavior, and may include other select roadside assistance and safety benefits. For these features to work, the corresponding Mobile Software must be installed on your phone, your phone must be with you while you are driving, your phone must be powered on and properly functioning, and your device settings and permissions must be properly configured.
Please do not use the road safety features in a way that distracts you while driving, or that interferes with your ability to follow traffic laws. The road safety features are NOT A REPLACEMENT FOR 911. In the event of a serious crash, or one that involves an injury, always dial 911 immediately.
A. Driver Behavior and Drive Detection.
Certain driver behavior monitoring and reporting features may be offered as part of the Family Safety Assist Services. These driver behavior detection and reporting features are designed to detect (where available) details about driving behavior and driving events. These features may not function if you are driving outside of your wireless service coverage area for the phone that the Mobile Software for the driver behavior features is installed on, or if your phone is otherwise not connected to your wireless service provider’s network, or if your device settings and permissions are not properly configured.
To enable driver behavior monitoring and reporting features, the Company must be able to access and collect location, sensory and motion data from your smartphone or mobile device, including information from the gyroscope, accelerometer, compass and Bluetooth, to calculate and detect driving events and behaviors, such as the speed of your automobile, braking habits, distracted driving, distances and precise routes driven, stops and check-ins, and other driving events and behavior. Your device settings and permissions must be properly configured, for example, by turning location permissions to “Always On,” for the drive detection and reporting features to work properly.
B. Crash Detection.
While the crash detection feature is designed to help you in the event of a major collision, it may not detect all crashes or be able to communicate with Company or our Third Party Provider, as applicable, or a 911 center in the event of a crash. For example, the driver protection features may not be able to detect a particular crash (including, without limitation, if the automobile is moving at a low speed, or is stopped at the time of a crash), hardware limitations or battery life may prevent crash detection, limitations or errors in the algorithms and processes used by the Service may not function properly, and crashes may not be detected if you are located outside of your wireless service coverage area for the phone that the Mobile Software for the crash detection features is installed on or if your phone is otherwise not connected to your wireless service provider’s network (e.g., it will not work if the phone is connected to a wi-fi network). Your device settings and permissions must be properly configured, for example, by turning location permissions to “Always On,” for the crash detection services to work properly. Other factors also may prevent accurate crash detection.
Depending on the features and functionality available for your level of membership, if a crash is detected, the emergency response features may prompt you to determine whether you need assistance, and it may utilize your phone to communicate with a call center provided by Company or our Third Party Provider, or 911 center, to help you seek assistance. The emergency response features will collect your precise location information, driving behavior data and other information and may transmit such information to members of your Circle and emergency contacts, to call center personnel (provided by Company or by a Third Party Provider acting on behalf of Company), and/or to a 911 center or other emergency response professionals (e.g., police, fire department, paramedics, etc.). By using or subscribing to the driver protection features, you expressly consent to allow Company or the applicable Third Party Provider or emergency response professional to contact you or your phone by push notification, text message, or call, including through use of an automatic telephone dialing system, including in connection with the crash detection and emergency response features of Family Safety Assist Service.
C. Not Responsible for Emergency Response Services.
The emergency response features are NOT A REPLACEMENT FOR 911. In the event of a serious crash, or one that involves an injury, always dial 911 immediately.
Company and our Third Party Providers shall have no liability for permit fees or fines, false alarms, false alarm fines, police or fire response, any damage to personal or real property or personal injury caused by police or fire department response to an emergency alert, whether false alarm or otherwise, or the refusal of the police or fire department to respond or the timeliness of the response.
D. No Warranty for Road Safety Services.
Although it has taken what it believes to be commercially reasonable efforts to design helpful driver safety and protection features, to the extent permitted by law COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE OPERATION, PERFORMANCE, AVAILABILITY, OR RESULTS OF ANY ROAD SAFETY FEATURES, INCLUDING (WITHOUT LIMITATION) THAT THE ROAD SAFETY FEATURES WILL: SUCCESSFULLY DETECT CRASHES, COMMUNICATE WITH YOU OR A COMPANY OR 911 CENTER IN THE EVENT OF A CRASH, OR CONTACT ANY ROADSIDE ASSISTANCE SERVICE. COMPANY IS NOT LIABLE FOR THE ACTIONS OR INACTIONS OF ANY USER, 911 CENTER, EMERGENCY RESPONDER, ROADSIDE ASSISTANCE PROVIDER, OR ANY OTHER THIRD PARTY OR FOR ANY LOSS, PERSONAL INJURY OR PROPERTY DAMAGE SUSTAINED BY YOU AS A RESULT OF CAR CRASH, OR ANY OTHER CAUSE. Some jurisdictions do not allow for the disclaimer of certain warranties, so the disclaimers above may not apply to you.
6. Special Terms Pertaining to Place Alerts, Check-Ins and SOS Alerts
A. Place Alerts and Check-Ins.
The Family Safety Assist Services include features like Place Alerts and Check-Ins to alert your Circle members when you arrive or leave a specific location. These features may not work properly due to hardware limitations or battery life, limitations in GPS service availability, or if the mobile device settings and permissions are not properly configured or outside of wireless service coverage area. Other factors may also prevent accurate Place Alerts and Check-Ins. For example, if you set up Places that overlap each other or are extremely close, or if you are logged into the Life360 Service on multiple devices at the same time, your Place Alerts and Check-Ins may not be accurate.
B. Emergency Contacts and Automated SOS.
Emergency contacts are people you would like Company to contact if you send an Automated SOS alert, or if we detect an emergency like a major car crash. They will not see your location unless you send an Automated SOS alert, or unless an Automated SOS alert is triggered on your behalf. The people you designate as emergency contacts must accept your invitation to be an emergency contact for your Circle in order to receive emergency alerts phone calls and texts from Company.
